1. Acceptance of Terms

By accessing or using the AI Smart Life platform ("Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. These Terms constitute the entire agreement between you and AI Smart Life regarding your use of the Service. If you do not agree to any part of these terms, you must discontinue use of the Service immediately. We reserve the right to refuse service to anyone who violates these Terms or for any other reason at our sole discretion.

2. AI-Generated Content Disclosure

All visual and textual outputs produced by our Service are generated by artificial intelligence (AI) technology. These outputs are not real photographs, not genuine documents, and do not depict actual events. AI-generated content is clearly labeled as such throughout our platform. You acknowledge and accept that AI technology has inherent limitations and may produce outputs that contain inaccuracies, visual artifacts, or unrealistic elements. We provide these outputs "as-is" without warranties of accuracy, authenticity, or fitness for any particular purpose.

  • Generated images may contain visual inaccuracies, artifacts, or anatomically unrealistic elements that do not occur in real photography.
  • AI outputs may share characteristics with other AI-generated images due to the nature of the underlying machine learning models.
  • You must not present AI-generated outputs as authentic photographs, real documentation, or records of real events.
  • You must not use AI-generated outputs for fraudulent, deceptive, or misleading purposes, including but not limited to identity fraud, financial fraud, or impersonation.
  • All generated images contain C2PA metadata identifying them as AI-generated content and providing cryptographic verification of origin.
  • Removing, altering, or attempting to strip AI-generated labels or metadata violates these Terms and applicable laws.

3. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the Service. Prohibited behavior includes harassing or causing distress or inconvenience to any person, obscene or offensive content, or disruption of normal flow of dialogue within the Service. You specifically agree not to use the Service to:

  • Create, distribute, or possess content that is illegal in your jurisdiction, including but not limited to child sexual abuse material, terrorism-related content, or content promoting violence.
  • Generate content that is harmful, threatening, abusive, defamatory, obscene, or contains hate speech targeting individuals or groups based on protected characteristics.
  • Generate content that impersonates real, named individuals without their explicit written consent, including public figures, celebrities, or private individuals.
  • Produce deepfakes or misleading media intended to deceive others, influence elections, manipulate public opinion, or cause reputational damage.
  • Create content that violates any applicable laws, regulations, or the intellectual property rights of third parties.
  • Sell, distribute, license, or otherwise commercialize AI-generated content as authentic, real, or unmodified photographs without clear disclosure.
  • Use the Service to harass, stalk, threaten, or intimidate any individual or group.
  • Attempt to circumvent security measures, reverse-engineer the AI models, or gain unauthorized access to the Service's infrastructure.
  • Resell or redistribute access to the Service without authorization.

4. Intellectual Property Rights

You retain all intellectual property rights to images you upload to our Service. However, by uploading content to AI Smart Life, you grant us a limited, non-exclusive license to process and use those images solely for the purpose of generating your requested AI outputs. AI-generated outputs are provided to you for personal, non-commercial use. You acknowledge that AI-generated content may share visual or stylistic similarities with other AI-generated outputs due to the nature of the underlying machine learning models, and therefore does not constitute unique creative authorship or original expression in the copyright sense. You may not claim copyright ownership over AI-generated outputs in jurisdictions where copyright requires human creative authorship. The underlying AI models, algorithms, and technologies used by AI Smart Life are owned or licensed by AI Smart Life or its technology partners, and you may not attempt to extract, replicate, or commercialize these models.

5. Payment Terms and Refund Policy

Each AI generation service is priced at $2.00 USD per generation. Payment must be completed in full before results are delivered. Payment is processed securely through Stripe, and you authorize Stripe to charge your selected payment method for the full amount. We accept major credit cards, debit cards, and other payment methods supported by Stripe. All payments are in United States dollars. If your location imposes additional taxes or fees, you are responsible for paying those amounts. We are not responsible for currency conversion fees or international transaction charges imposed by your financial institution.

All sales of AI generation services are final once the AI result has been generated and made available for download. You acknowledge that AI-generated outputs are intangible digital goods that are instantly delivered and cannot be returned. Refunds will only be considered and are made entirely at our discretion on a case-by-case basis for the following limited reasons: (1) technical failure of the Service resulting in an incomplete or unusable output, (2) service interruption lasting more than 24 hours, or (3) payment processing errors. Refund requests must be submitted within 7 days of the transaction. We reserve the right to decline refund requests that do not meet these criteria. If a refund is approved, it will be credited to your original payment method within 5-10 business days.

6. User Responsibilities and Liability Limitations

You are solely responsible for all content you upload to the Service and for all uses you make of AI-generated outputs. You assume all risk associated with using the Service and AI-generated content. You are responsible for obtaining necessary licenses, permissions, or consents before uploading content to the Service. You are responsible for ensuring that your use of AI-generated content complies with all applicable laws, regulations, and third-party rights in your jurisdiction. If you use AI-generated content in a way that violates these Terms or applicable law, you agree to indemnify and hold harmless AI Smart Life, its owners, operators, and technology partners from any claims, damages, losses, or expenses (including legal fees) arising from such violation.

7. Data Handling and Privacy

Uploaded images are transmitted securely to third-party AI services (Stability AI and DeepSeek) solely for the purpose of generating your requested output. We do not permanently store your uploaded images on our servers. Generated results are delivered to your browser in real-time and stored only in your local session until you choose to download them. We do not retain copies of generated outputs after your session ends. 8. Warranty Disclaimer and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR MEET YOUR EXPECTATIONS. WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM THE USE OF AI-GENERATED CONTENT, INCLUDING BUT NOT LIMITED TO INACCURACIES, ARTIFACTS, MISUSE, RELIANCE ON OUTPUTS, OR CONSEQUENTIAL DAMAGES.

IN NO EVENT SHALL AI SMART LIFE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Modifications to Terms and Service

We reserve the right to modify these Terms of Service at any time without prior notice. Continued use of the Service after any such modifications constitutes your acceptance of the updated terms. We also reserve the right to modify, suspend, or discontinue the Service (or any portion thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Peru, without regard to its conflicts of laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved exclusively through direct negotiation between the parties. If a dispute cannot be resolved through negotiation within 30 days, the parties agree to resolve the dispute through binding arbitration in accordance with applicable law. You agree that any legal action or proceeding must be brought exclusively in your local jurisdiction and you consent to the personal jurisdiction of such courts.

11. Termination of Access

We reserve the right to terminate or suspend your access to the Service immediately and without notice if we determine that you have violated these Terms or engaged in any conduct that we deem harmful to other users or to the Service. Upon termination, your right to access the Service ceases immediately. Sections of these Terms that are intended to survive termination, including but not limited to intellectual property provisions, limitation of liability, and indemnification, shall continue in effect after termination.
